They are discussing Wade v. Auto Club Insurance Company of Florida et al., a recent case in Florida. Wade missed his April 8th deposition and failed to communicate that he would be going to Arkansas to watch the solar eclipse on that day. As a result, the defendant’s attorneys are asking for the entire case to be dismissed, to get attorney’s fees, and specifically for the case to be thrown out with prejudice, essentially barring him from any other chance of getting into court with his claim.
Though not conducted in a courtroom, depositions bear all the gravitas of a court proceeding, typically supervised by a court reporter and sometimes recorded on video. This formal setting ensures that testimonies given during depositions carry significant weight and may be used in a trial, akin to direct courtroom testimony.
